BackgroundResearch ethics and the measures deployed to ensure ethical oversight of research (e.g., informed consent forms, ethics review) are vested with extremely important ethical and practical goals. Accordingly, these measures need to function effectively in real-world research and to follow high level standards.MethodsWe examined approved consent forms for Magnetic Resonance Imaging (MRI) and functional Magnetic Resonance Imaging (fMRI) studies approved by Canadian research ethics boards (REBs).ResultsWe found evidence of variability in consent forms in matters of physical and psychological risk reporting. Approaches used to tackle the emerging issue of incidental findings exposed extensive variability between and within research sites.ConclusionThe causes of variability in approved consent forms and studies need to be better understood. However, mounting evidence of administrative and practical hurdles within current ethics governance systems combined with potential sub-optimal provision of information to and protection of research subjects support other calls for more scrutiny of research ethics practices and applicable revisions. According to a rights forfeiture theory of punishment, liability to punishment hinges upon the notion that criminals forfeit their rights against hard treatment. In this paper, I assume the success of rights forfeiture theory in establishing the permissibility of punishment but aim to develop the view by considering how forfeited rights might be reclaimed. Built into the very notion of proportionate punishment is the idea that forfeited rights can be recovered. The interesting question is whether punishment is the sole means (...) for reclaiming forfeited rights. I argue for a pluralistic theory of rights reclamation, according to which, there are multiple ways by which a wrongdoer can recapture her forfeited rights. In particular, I argue that offering remorseful compensation is a valid means by which a wrongdoer might partially, or fully, reclaim her right against punishment. (shrink)

The first and greatest commandment according to Jesus, and so the one most central to Christian practice, is the command to love God. We argue that this commandment is best interpreted in aretaic rather than deontic terms. In brief, we argue that there is no obligation to love God. While bad, failure to seek and enjoy a union of love with God is not in violation of any general moral requirement. The core argument is straightforward: relations of intimacy should not (...) be morally imposed upon autonomous beings. We contend that such reasoning applies to human beings’ relationship to God. So, even if our ultimate end is to enjoy communion with God, God has no right that human beings seek a relationship with him. If this is correct, then the command to ‘love God’ is not the sort of moral principle that can be supported by threats of hellfire or other forms of coercion. (shrink)

There are a number of pressing issues related to this topic, but in this essay, I will focus upon the problem of prison violence. Inadequate supervision has resulted in unsafe prison conditions where inmates are regularly threatened with rape, assault, and other forms of physical violence. Such callous disregard and exposure to unreasonable risk constitutes a severe violation (...) of the rights of prisoners by the state. While there have been numerous legal, political, and activist efforts to draw attention to this issue—with the goal of reforming and making prisons safer—my goal is different. I argue that inmates who are victims of prison violence should have their sentences automatically reduced. Two distinct arguments are advanced in support of this claim. First, I argue that acts of prison violence are a sort of state-mediated harm which can thus be appropriately described as punishment-constituting. Second, and more straightforwardly, I argue that the compensation owed to prisoners who are victims of prison violence may naturally take the form of a reduced sentence. (shrink)

This paper is concerned with Wittgenstein's early doctrine of the independence of elementary propositions. Using the notion of a free generator for a logical calculus–a concept we claim was anticipated by Wittgenstein–we show precisely why certain difficulties associated with his doctrine cannot be overcome. We then show that Russell's version of logical atomism–with independent particulars instead of elementary propositions–avoids the same difficulties.

A number of theologians and philosophers have found theodical value in the theme of divine solidarity with human suffering. To further develop this theme, I examine what it would mean to assert that Christ on the cross participated in a representative sample of human suffering. Particular attention is paid to Christ’s cry of dereliction. I argue that if God through Christ identified with the very worst kinds of human suffering on the cross, then the cry of dereliction should be interpreted (...) as indicating an epistemic break between God and Christ, and not merely an attentional disruption. According to this account, Christ’s death cry expressed his temporary inability to grasp the significance of his passion and death. In this way, Christ on the cross suffered the full effects of divine hiddenness, thus sharing with horror-sufferers the experience of meaning-negating suffering. (shrink)

Two important assumptions of behavioral momentum theory are contradicted by existing data. Resistance to change is not due simply to the Pavlovian contingency between a discriminative stimulus and the rate of reinforcement in its presence, because variations in the response-reinforcer contingency, independent of the stimulus-reinforcer contingency, produce differential resistance to change. Resistance to change is also not clearly related to measures of preference, in that several experiments show the two measures to dissociate.

The field of behavioral ethics has seen considerable growth over the last few decades. One of the most significant concerns facing this interdisciplinary field of research is the moral judgment-action gap. The moral judgment-action gap is the inconsistency people display when they know what is right but do what they know is wrong. Much of the research in the field of behavioral ethics is based on early work in moral psychology and American psychologist Lawrence Kohlberg’s foundational cognitive model of moral (...) development. However, Kohlberg’s model of moral development lacks a compelling explanation for the judgment-action gap. Yet, it continues to influence theory, research, teaching, and practice in business ethics today. As such, this paper presents a critical review and analysis of the pertinent literature. This paper also reviews modern theories of ethical decision making in business ethics. Gaps in our current understanding and directions for future research in behavioral business ethics are presented. By providing this important theoretical background information, targeted critical analysis, and directions for future research, this paper assists management scholars as they begin to seek a more unified approach, develop newer models of ethical decision making, and conduct business ethics research that examines the moral judgment-action gap. The dominance of the Abrahamic tradition in contemporary analytic philosophy of religion has led some to call for greater exploration of alternatives to the traditional conception of God, such as Pantheism, Ultimism, and Axiarchism. While we think this call for alternatives is important, we go in a different direction. Rather than explore and defend alternative conceptions of God, we defend a range of fairly traditional but non-religious conceptions of God. Robert Coles' sentiment characterizes well the moral tenor of medical education today. Indeed, medical educators are frequently “seized by spasms of genuine moral awareness,” as they try to cope with the massive social and economic problems that face medical schools and teaching hospitals. The perception among educators that we currently fail to adequately teach several core aspects of doctoring, including professional values and behavior, constitutes one such spasm. In this case, the proposed remedy has generated considerable enthusiasm, but whether the (...) “core competencies” curriculum will make a difference, or simply “accommodate to the prevailing rhythms of the world we inhabit,” remains to be seen. Population-level biomedical research offers new opportunities to improve population health, but also raises new challenges to traditional systems of research governance and ethical oversight. Partly in response to these challenges, various models of public involvement in research are being introduced. Yet, the ways in which public involvement should meet governance challenges are not well understood. We conducted a qualitative study with 36 experts and stakeholders using the World Café method to identify key governance challenges and explore how public involvement can (...) meet these challenges. This brief report discusses four cross-cutting themes from the study: the need to move beyond individual consent; issues in benefit and data sharing; the challenge of delineating and understanding publics; and the goal of clarifying justifications for public involvement. The report aims to provide a starting point for making sense of the relationship between public involvement and the governance of population-level biomedical research, showing connections, potential solutions and issues arising at their intersection. We suggest that, in population-level biomedical research, there is a pressing need for a shift away from conventional governance frameworks focused on the individual and towards a focus on collectives, as well as to foreground ethical issues around social justice and develop ways to address cultural diversity, value pluralism and competing stakeholder interests. There are many unresolved questions around how this shift could be realised, but these unresolved questions should form the basis for developing justificatory accounts and frameworks for suitable collective models of public involvement in population-level biomedical research governance. This book explores and articulates the concepts of the continuous and the infinitesimal from two points of view: the philosophical and the mathematical. The first section covers the history of these ideas in philosophy. Chapter one, entitled ‘The continuous and the discrete in Ancient Greece, the Orient and the European Middle Ages,’ reviews the work of Plato, Aristotle, Epicurus, and other Ancient Greeks; the elements of early Chinese, Indian and Islamic thought; and early Europeans including Henry of Harclay, Nicholas of (...) Autrecourt, Duns Scotus, William of Ockham, Thomas Bradwardine and Nicolas Oreme. The second chapter of the book covers European thinkers of the sixteenth and seventeenth centuries: Galileo, Newton, Leibniz, Descartes, Arnauld, Fermat, and more. Chapter three, 'The age of continuity,’ discusses eighteenth century mathematicians including Euler and Carnot, and philosophers, among them Hume, Kant and Hegel. Examining the nineteenth and early twentieth centuries, the fourth chapter describes the reduction of the continuous to the discrete, citing the contributions of Bolzano, Cauchy and Reimann. Part one of the book concludes with a chapter on divergent conceptions of the continuum, with the work of nineteenth and early twentieth century philosophers and mathematicians, including Veronese, Poincaré, Brouwer, and Weyl. Part two of this book covers contemporary mathematics, discussing topology and manifolds, categories, and functors, Grothendieck topologies, sheaves, and elementary topoi. Among the theories presented in detail are non-standard analysis, constructive and intuitionist analysis, and smooth infinitesimal analysis/synthetic differential geometry. No other book so thoroughly covers the history and development of the concepts of the continuous and the infinitesimal. (shrink)

We examined cynicism as a mediator of the influence of managers’ mission-congruent communication and behavior about ethical standards (a form of supervisory behavioral integrity) on employee attitudes and intended behavior. Results indicated that cynicism partially mediates the relationship between supervisory behavioral integrity and organizational commitment, but not the relationship between supervisory behavioral integrity and intent to comply with organizational expectations for employee conduct.

John King-Farlow's ‘The Positive McTaggart on Time’ brings out extremely important likenesses between ‘abstract’ metaphysicians and ‘concrete’ philosophers of science. These striking similarities illustrate a perennial human quest for Something More Basic than Time, a quest which characterizes not only mystics who rejoice in contradictions but hard-headed philosophers who submit to the rigours of logic. King-Farlow is largely concerned with the McTaggart of 1908 and his motivation for writing ‘The Unreality of Time’. I should like to explore further (...) the surprising bond between the Search for Something Deeper in the later McTaggart of The Nature of Existence and the writings on Time of Hans Reichenbach and Adolf Grünbaum. Reflection on this similarity should enable us better to evaluate the view that our vulgar, if practically useful, assertions about Time's Arrow must be reinterpreted by the wise in terms of chastened logical constructions out of statements about Something Deeper—logical constructions which are alleged, if chaste enough, to be eliminable. An experimental study is reported which investigates the differences in interpretation between content conditionals (of various pragmatic types) and inferential conditionals. In a content conditional, the antecedent represents a requirement for the consequent to become true. In an inferential conditional, the antecedent functions as a premise and the consequent as the inferred conclusion from that premise. The linguistic difference between content and inferential conditionals is often neglected in reasoning experiments. This turns out to be unjustified, since we adduced evidence on (...) the basis of a quantitative and a qualitative analysis that this difference has a manifest psychological relevance. For the inferential conditionals, participants appear to retrieve the order of events of the original content conditional on which it was based, before they start reasoning with it. The implications of this finding for reasoning research and linguistics will be discussed. (shrink)

BELL Emory University Atlanta, Georgia MANY works associated with Thomas Aquinas stand both the Office and Mass for the Feast of Corpus Christi.1 The earliest witness to this association comes from two of Thomas's Dominican brothers and younger contemporaries, Tolomeo of Lucca and William of Tocco. Around 1317 Tolomeo wrote in his Historia Ecclesiastica: (...) " Thomas composed [the Corpus Christi Office] in full, including the lessons and all the parts to be recited by day or night; the Mass, too, and whatever has to be sung on the day." 2 William, in his Historia beati Thomae completed around 1320, lists the liturgy of Corpus Christi among Thomas's works and informs us that Thomas wrote the liturgy " at the request of Pope Urban [IV]." 3 It is known that on August 11, 1264, Urban, in the bull Transiturus, declared that the Feast of Corpus Christi was to be celebrated throughout Christendom according to a "new, Roman," liturgy.4 Thomas had returned from Paris to Italy, his 1 This does not mean that Thomas created the liturgy for the feast de nova. Furthermore, by 1264 he had developed a "warm friendship" with Urban, whom we know to have commissioned Thomas to write several works between 1261 and 1265.5 These facts have led most scholars since the early fourteenth century to conclude that Urban's "new" liturgy was the work of Thomas.6 In recent years, however, Cyrille Lambot has questioned whether Thomas wrote or compiled the liturgy promulgated by Urban. He has noted that Reginald of Piperno, Thomas's amanuensis and companion from 1259 to 1274, did not include the liturgy for Corpus Christi in his list of Thomas's works. Moreover, the Dominican Order, like most Orders and dioceses, did not adopt Urban's liturgy for the Feast of Corpus Christi until 1317, when John XXII required its use throughout Western Christendom.7 If Thomas had written the liturgy, argues liturgy composed for the celebration of Corpus Christi. Around 1246 a certain John, a religious of Mont-Cornillon, had compiled a liturgy for the " Body of the Lord " that was in place throughout the diocese of Liege. Being so impressed by the solemnities of the Liege eucharistic celebration, Hugh of Saint-Cher, a Dominican and the cardinal legate of Germany, declared in 1252 that the feast of Corpus Christi was to be celebrated throughout the territory under his leadership. Jacques Pantaleon, the future Urban IV, knew the solemnities of Liege from his time as the city's archdeacon. It seems that upon his election as Pope, Urban was urged by many people to establish the Feast throughout Christendom. Eventually he did this with the publication of the bull Transiturus. As the technician inserted the rather ominous cotton-tipped probe into my nostril, she told me that it was going to feel as if she were tickling my brain. Indeed… This experience, shared by many during the past three years, and likely multiple times, prompted me to think about my nose. Not since cocaine reentered American mainstream culture (...) in the 1970s and '80s—and found its way into countless movies that reflect the trend—has the nose been so central to a certain state of public life. It's difficult to find a film dealing with American culture from that period and beyond, from Scarface to The Wolf of Wall Street, in which there is not a scene depicting characters snorting the obligatory line or spoon of cocaine. Yes, snorting, sniffing, sneezing, ingesting the line through the nose and finishing leftover dust by collecting it with a moist finger, rubbing it lovingly against the front gum of the mouth. Freud's "Über Coca" looms ominously in the background, the work of a phase in Freud's professional career complicated by his obscure relationships with Parke-Davis (now a subsidiary of Pfizer) and Merck, pharmaceutical companies that supplied him with early samples to tickle his nose (Freud; Merkel). The Sacklers of the moment. In our day, Pfizer wants to transform our noses into defenses against the virus rather than conduits toward mind-altering dreams. In the wake of the Freud and William Halsted cocaine addictions chronicled by Howard Merkel, the irony of the contemporary link between Pfizer and the nose is patent.The nose: that orifice through which the virus creeps, the first stage in breathing, the first filter for air-borne pollutants. Recently, important immunological analyses of COVID have focused on the question of viral load, how much virus is necessary to overcome the nose's filtering function and reach the deeper airways leading to the lungs. The processes triggered by any of the major vaccines prepare antibody blueprints and actual antibodies that can be dispatched to the linings of the nose to counter the virus as soon as the body detects its presence. The Delta, Omicron, and subsequent variants remind us that the virus has mechanisms to challenge this response, namely, increased viral load that intensifies transmissibility and the potential to overwhelm antibodies. It seems, however, that [End Page 231] so-called breakthrough infections are still well controlled by the body's vaccinated immune system. Hysteria about the dangers of such incursions is partially a product of biased and often incorrect or incomplete media coverage of the COVID vaccine, which has terrified the vaccinated and fueled the skepticism of the unvaccinated.The virus tries to overpower and confuse the filtering nose in another way, more immediately apparent to our conscious selves. As many as eighty-five percent of COVID infections result in the loss of smell, generally recovered in about two to three weeks in sickened people who overcome the infection. About five percent of COVID victims, however, have not recovered their sense of smell six months or more after they have shed the virus.1 What might it mean to lose one's sense of smell? In our vision-oriented culture, both sound (the ear) and smell (the nose) have been less recognized as primary defense mechanisms than in other cultures. When one hears a sound, the first reaction is to prepare for a threat, before the sonic source is seen or understood. Orientation in the world, knowing from which direction the sound emanates, is key to preparing the body for an encounter with an unknown phenomenon: "To sound (an alarm) means to warn. Isn't any emerging sound understood as a warning? Any unexpected sonic occurrence is seen as an indication of something that is to come and that must be clarified rapidly" (Deshays 34). By the same token, to sample surroundings by sniffing what is in the air signals whether one should inhale or somehow try to hold one's breath in search of cleaner, more palatable air. In this article I argue that, if one is persuaded by the arguments of Emmanuel Levinas, the pursuit of something called ‘ethical feminism’ is rendered difficult, for, according to Levinas, there is a hiatus between ethics and politics in so far as politics does not flow from ethics. Indeed, politics obliges one to engage in the non-ethical, so that the ethical cannot be understood as a basis for feminist politics. I contend that one can argue that it is in the (...) way that the dangers of the non-ethical are handled that politics begins. If this is so, one can refigure the question of ethics within feminism. Ethics becomes a check on freedom and politics rather than its originary source. However, I argue, along with Michel Foucault and William Connolly, that ethical responses, while coming from the other, have also to be subjected to genealogical critique, so that their conditions of possibility are not naturalized.
